Article R. 122-28 of the IPC indeed states that this opposition “ does not need to be justified and can be expressed by any means. In the case of content made available to the public online, this opposition can notably be expressed by machine-readable methods, including metadata, and by recourse to general terms of use of a website or service ”.
It is recalled that within the framework of its activities, the Kenchana company may authorize its contractors and/or press organizations to use the audiovisual works, content, and/or any of their components protected by copyright (text, graphics, signs, signals, sounds, images, etc.) present on the Site, solely to the extent necessary for the realization of the authorized exploitation or the needs for information. However, these authorizations do not allow these contractors and/or press organizations to make copies or digital reproductions of these works and/or content and/or their components for the purpose of text and data mining, nor to authorize a third party to do so, particularly an AI system.
Consequently, all operations of text and data mining by an AI system using the audiovisual works, content, and/or any of their components protected by copyright (text, graphics, signs, signals, sounds, images, etc.) presented or made available to the public online on this Site or by third parties, whether this availability is done by excerpts or in full, freely accessible for free or for a fee, constitute acts of infringement, liable to the penalties provided for in Articles L. 331-1 and following of the IPC, unless prior written agreement of the Kenchana company (or, where applicable, of the collective management organization to which Kenchana has expressly entrusted a mandate for this purpose) is obtained.
